Terms of Service

1. About these terms

These Terms of Service (the “Terms”) govern your use of POD Prompt Builder and POD Prompt Builder Studio and the websites and tools that go with them (together, the “Service”). In these Terms, “we” and “us” mean POD Prompt Builder.

By creating an account, starting a free trial, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Your account

You must be old enough to enter into a binding contract where you live, and you must give us accurate information when you sign up. You are responsible for keeping your password secure and for everything that happens under your account. Accounts are for one person and may not be shared or resold.

To keep the free trial fair, we may limit or refuse trials, for example repeat trials from the same person or network, and we may use the sign-up checks described in our Privacy Policy.

3. Free trial

The free trial lasts 7 days and does not need a payment card. During the trial you can use all of POD Prompt Builder. POD Prompt Builder Studio works with simulated test stores during the trial: nothing is created in, or sent to, any real Printify, Shopify or WooCommerce account, and nothing is sold.

When the trial ends, access pauses until you subscribe. We never charge you for a free trial.

4. Subscription and billing

After the trial, full access is available as a monthly subscription. The price shown at checkout applies (currently US$6.99 per month, plus any taxes that apply). Payment is taken in advance through PayPal and the subscription renews automatically each month until you cancel.

If we change the price, we will tell you before the change takes effect, and you can cancel before it applies to you. If a payment fails, we may suspend access until it is resolved.

Some early members hold a lifetime licence. It lasts for as long as we operate the Service, and it cannot be transferred.

5. Cancellation and refunds

You can cancel at any time from your PayPal account (Settings, Payments, Manage automatic payments). When you cancel, you keep access until the end of the month you have already paid for, and you will not be charged again.

If the Service is not right for you, email [email protected] within 7 days of your first payment and we will refund it in full. After that, payments are not refundable, except where the law requires otherwise.

6. Your content

You keep ownership of the designs, prompts, listings and other content you create or upload (“Your Content”). You give us a limited permission to store, process and display Your Content only as needed to run the Service for you, for example to remove a background, create a mockup, or send a draft product to your store.

You are responsible for Your Content. You confirm that you have the rights to use it and that it does not break the law or anyone else’s rights. Keep your own copies of your designs: we do not promise to keep them indefinitely.

7. Designs, trademarks and AI-generated artwork

POD Prompt Builder helps you write prompts and prepare artwork. The pictures themselves are made with third-party AI image tools that you choose and use under their own terms. We do not generate your images and we do not guarantee that any image, phrase or listing is original or free of third-party rights.

Features such as the phrase check and the trademark audit link are informational aids only. They are not legal advice and can miss conflicts. You are responsible for checking that your designs, phrases and listings do not infringe copyrights, trademarks or other rights before you publish or sell them.

8. Third-party services

The Service works with services we do not control, including Printify, Shopify, WooCommerce, PayPal and AI image tools. Your use of them is governed by their own terms and fees. You connect your own accounts and you can disconnect them at any time.

When you ask us to, we use your connected accounts to create products as drafts. You are responsible for reviewing and publishing them, and for your pricing, orders, fulfilment, taxes, customer service and compliance with each platform’s rules. We are not responsible for outages, changes, fees or account actions taken by these third parties.

9. Listings, mockups and results

Listing text, keywords and mockups are suggestions to help you work faster. Please review them before you publish. Mockups are previews, and the final product is determined by your print provider. We do not promise any level of sales, search ranking, marketplace approval or income.

10. Acceptable use

Please do not use the Service to break the law, to infringe others’ rights, or to create deceptive or harmful content. Please do not try to get around trial or account limits, interfere with the Service or its security, copy or reverse-engineer it, overload it, or resell access to it.

11. Availability and changes

We work to keep the Service available, but it is provided as it is, and we may change, suspend or discontinue features at times. We will try to give notice of significant changes.

12. Ending your use

You can stop using the Service at any time. We may suspend or end your access if you break these Terms, abuse the Service or the free trial, or fail to pay. If your access ends, you lose access to the Service, and we may delete your data after a reasonable period as described in our Privacy Policy.

13. Disclaimers and limits of liability

To the fullest extent the law allows, the Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

To the fullest extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, sales, data or goodwill. Our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose (or US$50 if you have not paid us anything). Nothing in these Terms limits liability that cannot be limited by law.

14. Your responsibility to us

You agree to cover us against claims and costs arising from Your Content, your products and listings, or your breach of these Terms or of someone else’s rights.

15. Changes to these Terms

We may update these Terms from time to time. When we make a significant change, we will update the date at the top of this page and, where appropriate, tell you by email. If you keep using the Service after a change, you accept the updated Terms.
